Incorporated as a trust company in Bermuda in 1956, Appleby Trust (Bermuda) Ltd has established professional relationships with many of the world’s leading banks, investment advisors and custodians.

Appleby Trust (Bermuda) Ltd is owned by the partners of one of Bermuda’s largest law firms, Appleby Spurling Hunter. With origins that date back to 1897, and practising in its current form since 1938, Appleby Spurling Hunter is one of Bermuda’s leading firms, and is able to provide Appleby Trust (Bermuda) Ltd’s local and international clients with advice in matters of trust, estate and corporate planning.

Through its sister companies, Appleby Corporate Services (Bermuda) Limited and Reid Management Limited, Appleby Trust (Bermuda) Ltd is also able to offer corporate administrative and resident representative services to client companies as well as full management, accounting and consulting services.

A licensed trust company under the Trust Companies Act 1991, Appleby Trust (Bermuda) Ltd provides a full range of services related to trusts and estates. In particular, Appleby Trust (Bermuda) Ltd acts as:

Trustee of family, purpose and charitable trusts;

Trustee of pension and employee benefit schemes;

Executor in relation to the disposition of estates;

Protector in relation to family and charitable trusts to protect the purposes of the trust and the interests of its beneficiary or beneficiaries;

Enforcer in relation to purpose trusts in accordance with the statutory provisions of the Trusts (Special Provisions) Act 1989;

Nominee to hold property for the beneficial owner; and

Escrow agent.

Administration of companies owned by client trusts.

On the corporate side, much of our work is related to the setting up of special purpose vehicles ("SPVs") which fill a vital function in relation to our clients’ corporate structures. These SPVs may be set up for a variety of reasons, ranging from the commercial leasing of aircraft, ships or helicopters, to reasons related to financial re-structuring or debt-raising.

Appleby Trust (Bermuda) Ltd is able to offer high net worth individuals and families a full suite of services related to family office planning. Harrington does not provide banking or investment management services, although the Firm works closely with offshore investment professionals to establish investment goals and monitor their performance.

Regulation

All trust companies in Bermuda are licensed in accordance with the Trust Companies Act 1991. The legislation provides that any company that conducts trust business must have sufficient personnel with the knowledge, skill and experience necessary for the conduct of the company’s business, as well as procedures in place to ensure that those personnel are of sufficient standard. We are confident that our personnel and procedures more than satisfy that standard.

All trust companies in Bermuda are also regulated and monitored by the Bermuda Monetary Authority.

We are also a "regulated institution" as defined by the Proceeds of Crime Act 1997 and the Proceeds of Crime (Money Laundering) Regulations 1998. This legislation has affirmed Bermuda’s "know your client" culture, and enhances Bermuda’s reputation as a financial jurisdiction of the highest integrity.
